Planning Legislation Updates

The Planning (Scotland) Act 2019 (Commencement No 6 and Transitional Provision) Amendment Regulations 2021 came into force on 29 September 2021.
They postpone the 18-month time-limit for making a planning permission application where pre-application consultation (‘PAC’) requirements apply from 1 October 2021 until 1 April 2022.
The Town and Country Planning (Miscellaneous Temporary Modifications) (Coronavirus) (Scotland) Regulations 2021 also came into force on 29 September 2021 and amend provisions of the Coronavirus (Scotland) Act 2020 by:
- further extending the duration of planning permission, planning permission in principle, listed building consent and conservation area consent.
- suspending requirements for public events in PAC consultation until 31 March 2022.
- removing the temporary suspension of the requirement to hold a local review body meeting in public from the end of 30 September 2021.
